The Push for Medical Marijuana in North Carolina Gains Momentum

Medical marijuana may finally be on the horizon in North Carolina. For years, the state has remained one of the only in the country with no legal access to marijuana, but that could be changing soon. The N.C. Compassionate Care Act, also known as Senate Bill 3 (SB3), is gaining traction; If it makes it through the House, North Carolina could become the next state to legalize medical marijuana through a tightly regulated program.
Medical Marijuana Clears the Senate, But the House Is Next
SB3 passed the North Carolina Senate with strong bipartisan support, clearing a 36–10 floor vote. It’s one step away from being sent to the House for consideration, where it faces a less predictable outcome. Last year, a nearly identical version of the bill passed the Senate but stalled in the House. This year’s version includes some minor updates, but the core structure remains the same: legalize marijuana for medical use under strict guidelines.
According to House Majority Whip Rep. Jon Hardister, there’s a growing shift in the House toward supporting the bill. “It seems like the attitude among members of the House is shifting more in favor of the legislation,” he recently told reporters. Who Would Qualify for Medical Marijuana?

What Would the Program Look Like?

Regulation and Oversight
A new state program called the Medical Cannabis Production Commission would be created to oversee marijuana growing, manufacturing, and distribution. This commission would issue up to 10 licenses to companies allowed to cultivate and produce marijuana for medical use.
Each license-holder could operate up to eight dispensaries, officially called Medical Cannabis Centers. That means North Carolina could potentially see up to 80 dispensaries statewide, depending on license distribution.
Growing and Distribution
The law sets tight rules for marijuana cultivation:
Seed-to-sale tracking is required
Facilities must meet sanitation, quality, and security standards
Odor control, pesticide regulation, and product safety testing are all mandatory
Growers and processors would pay a 10% fee on all revenue
This level of regulation is designed to ensure public safety, prevent diversion to the black market, and maintain product consistency and quality.
What About the Dispensaries?
Under SB3, medical marijuana would only be sold at state-approved Medical Cannabis Centers. These dispensaries must follow strict rules, including:
No dispensary can be located within 1,000 feet of schools or churches
Hours of operation limited to 7:00 a.m. to 7:00 p.m.
Entry limited to registered patients and caregivers
No neon signs, marijuana leaf logos, or gimmicky branding
Advertising must be “tasteful, respectful, and medically focused”
The state aims to ensure that dispensaries resemble medical clinics more than retail shops, reinforcing the seriousness of the program.
